The
ministry of health and family welfare of India introduced the surrogacy bill in
the year 2016, for uplifting the rights of the surrogate mother as well as the
bill aimed at banning commercial surrogacy to protect women from exploitation.
Although the bill permits altruistic surrogacy under strict regulations, as an
agreement between the surrogate and infertile couple in which surrogate mother
will be paid for the entire medical bill. Surrogacy is only for the couple who
are married at least for the five years, and they do not have any biological,
adopted or surrogate child.
It
is prophecy of intend couple, that baby has to alive and healthy, for that a surrogate
mother must live a healthy lifestyle to take care of someone else’s child. The
age of the surrogate mother should be between 25-35 and her body mass index
(BMI) should be under 32. Intended parents basically want to make sure
surrogate is taking care of the pregnancy like they would, if it was their own
child were carrying.
Surrogacy
is said to an agreement, but there is no guarantee for baby’s life and health.
He or she is not any commodity that anyone can change or buy another after baby’s
death.
If
in case surrogate mother changed her mind upon birth and refused to hand over
the child to intended parents a legal action will be taken against her, but
what about her feeling that arose for baby, that emotional touch which she
recognize in nine months. Is it easy for her to give the baby on an agreement? As well as who will take care of her after
the birth of the baby?
The
surrogate carries infant in her womb for nine months and that duration is
sufficient to get emotionally connected with baby. The feeling which she comes
to know during the period of pregnancy is priceless, the moment when baby kick
and rotate around the wall of uterus is the most phenomenal feeling that a
woman feel in her lifetime. Just because of an agreement emotionally connected
bond broke up and relationship gets over. A surrogate mother cannot be
genetically related to that child, legally and psychologically, she will not be
having any right over the child even the name is also not revealed in the birth
certificate. There will be no connection of baby and surrogate mother after the
baby’s birth.
On
the other hand intended parents may not have the same parental bonding experience
with the child, they have to prepare for the emotional transfer of the baby and
ensure that they are ready to develop a healthy attachment. They have to
confirm the baby senses as from last nine month baby’s emotions was attached
with surrogate mother.
